By using this website and placing an order at Precious Cactus you certify that you are at least 18 years old.
These terms and conditions always apply if you use our Website or place an order through it, so please read them carefully.
Your use (accessing, browsing, buying, etc.) of this site is your legal agreement to the policies, terms and conditions stipulated on this page.
Shipping Terms
At Precious Cactus we send our orders by priority airmail, there is always a small risk of loss and we highly recommend to get the recommended documentation for your order if needed.
Shipping time depends not only upon our mail service, but also, of course, on your local postal services. For this reason, we can only give you an estimated shipping time based on our general experience. Normally average is 3 weeks, it can arrive before or later.
NOTE: Dear Californians, as we noticed that most of the problems with customs or agriculture department occurs in your beautiful state, we can’t be responsible anymore for any package that is seized by customs if you choose not to get the phytosanitary documents. Thank you for kind understanding. This statement also applies to Australia, New Zealand and everywhere in the world. We can’t be responsible for a cactus seized or returned to us because of your local laws especially if you don’t choose to add a phytosanitary to your order. Note that a phytosanitary certificate is maybe possible to do for your country, please contact us to check availability and conditions.
Dear Canadians, we noticed that your postal service is one of the lowest we have to deal with and also doesn’t track international parcels. That means that when we send your package, you can track it in the thailandpost website until Bangkok airport, then for no reasons your postal service doesn’t follow and update status. You have to know that before you order here. Same in Australia, but australian post seems to be faster but still no tracking.
Payment
If you have any problem with your payment durng your purchase, after making the purchase, if your package arrive late or anything that can may happen PLEASE CONTACT US FIRST.
Germination:
lophophora seeds, like all seeds in nature, are living organisms. We test our seeds after every harvest and keep them in a cold and dark place before sending. After 3 weeks we sow them for our own stock. So, seeds you buy here have been tested by us, are kept in optimal conditions before being sent, and are not more than 3 weeks old. 70 to 90% of the seeds should germinate when our recommended germination method is used. This is the results we have, with our proven method under our conditions and environment, after years of experience. Therefore, we cannot offer guarantees on germination rates, or promise that every seed in every pack will germinate or that you will achieve the same results as we get. Nature does not allow any company to be able to make such an absolute statement, and it would be misleading to customers to try to do so.
Returns:
Please note, we are happy to assist you with any queries about your order within 90 days from the date when the order is sent.
Should you wish to return purchased goods for any reason, you need to contact us first to confirm your return, within 14 days of receipt of your order. Any goods sent back without prior consent from us will be sent back at your cost and may not be accepted as a return.
Once you have confirmed your return with us, please send the items to our adress. All returns are the responsibility of the customer until they reach us.
The goods should be sent back with a recorded service as we will not be responsible for returns lost in the post.
When we receive the return package we will refund according to our refund policy.
Note that an unclaimed package returned to the sender is not a return.
Unclaimed orders:
When a packet reach its final destination but post office fails to deliver it for whatever reasons. In the case that you don’t go to post office to get your packet which is waiting for you it is an unclaimed orders or packet.
Reasons of post not delivering may be because adresse is not home at the moment of delivery, it also can be a mistake from the postman, wrong informations in the package, a wrong adress or indications….
In most of the cases, any id card and the tracking number of your package provided by email to you is enough to get your packet, you just need to go to your post office and you will get your packet. Some post office even let you arrange to schedule a redelivery or will tell you its exact location when you call them.
It is always faster to contact your post office in such case to gather informations, we are abroad and all our enquiries are based on local informations that our post will have to ask to your local post office. It will then take time to get answers, so you can cut part of this process and go directly to your post office, contact them or use the service provided in their website.
If you fail to solve the problem after some days, the packet may be destroyed or returned to the sender.
You are responsible of the packet so no refund will be granted if the packet is destroyed, lost in its way back or just damaged.
If the packet is sent back to the sender:
-For a cactus: A cactus is strong enough to accept a 3 weeks travel, more than that will damage the cactus. Unclaimed packet can take 2 months or even more from sender then back to sender. At this point the cactus is badly damaged by the lack of light, air, nutriments and stress, it can even die. A cactus is a living organism he needs some care. In such case no refund will be granted if the return to sender is not a mistake from us.
-For seeds: After such a long travel, seeds lost their freshness. We will grant a 50% refund of the value of the total order amount and we will cut 10$ for administrative and shipping costs.
Damaged / Faulty Goods
In the unlikely event that an item is found to be faulty or damaged, you may send it back for a replacement or refund. Please contact us within 14 days of receipt of your order and return the goods as per our returns policy above.
We will refund any postage costs incurred when returning items back to us. Overseas, items should only be returned using your country’s national postal service. We recommend using an insured delivery method; however we will not accept extra charges for guaranteed next day services or other courier services.
Your replacement goods will be shipped (or your payment will be refunded) within 14 days of receipt of your return minus our administration fee of $5,00.
Refunds
We will refund the cost of returned goods if prior agreement is validated. Shipping costs are non-refundable & additional administration fee is added.
Refunds will be made by crediting your card, a voucher or any other payment solution we agreed.
Refunds will be made within 14 days of receipt of your return.
Cancelation
Refunds and cancelations are only applicable if the order is still in our offices and was not shipped yet. If you wish to cancel a paid order or be refunded for a payment, you will need to contact us as soon as possible. Please note that we charge an administrative fee of $5 per transaction.
In case of events such as political troubles, climate disaster, pandemic, financial crisis or any circumstances that may block postal service or planes, we can grant a cancellation refund only 14 days after placing your order. After that 14 days time frame, a 5$ and a 10% fee will be deducted to your refund and it can take up to 2 months to refund depending on the political and financial situation a the moment.
Precious-cactus will never hand out your personal details to any third party. We use these details solely to process your order.

Package loss
Although it is rare for international orders to get lost, please be aware that it can happen. International orders may take up to 60 days to clear customs, sometimes they can be forwarded to the wrong hub at first then redirected, all the process depends on postal delivery method and government procedures. An international order will not be considered “lost” until 60 days have elapsed from the date of shipment. We are unable to process claims until this 60-day period has passed.
IN NO EVENT SHALL THE STORE OWNERS, ITS PARENT, SUBSIDIARIES, OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT THIS COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE COMPANY PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.
